Terms and Conditions
These Terms and Conditions govern access to and use of the website, customer account, proxy services, account credit and related services offered under the GenRDP brand. Please read them carefully before creating an account or placing an order.
Nothing in these Terms excludes or limits any rights that cannot lawfully be excluded or limited, including mandatory rights available to consumers under applicable law.
1. Contact
For assistance, contractual communications, legal notices and privacy-related requests, contact assistenza@genrdp.com.
In these Terms, “GenRDP”, “we”, “us” and “our” refer to the provider of the Services. “Customer”, “you” and “your” refer to the person or entity creating an account, placing an order or using the Services.
2. Scope and contractual documents
These Terms apply to the Services identified at checkout and in the corresponding order confirmation or invoice. Product-specific conditions displayed at checkout, the acceptable-use provisions, the Privacy Policy and any expressly incorporated service conditions form part of the applicable contractual framework.
The Privacy Policy describes how personal data is processed. The Cookie Policy and cookie-management interface separately govern cookies and similar technologies. Acceptance of these Terms must not be interpreted as consent to optional cookies or to processing activities that require separate consent.
If a product-specific condition conflicts with a general provision of these Terms, the product-specific condition applies to that Service, subject to mandatory law.
3. Accounts and registration
You must provide accurate, complete and current information when creating or updating an account. You must not impersonate another person, use false identity information or create an account on behalf of another person without authority.
You are responsible for protecting your account credentials and for activity carried out through your account, except where the activity results from a breach attributable to GenRDP. You must promptly notify GenRDP if you reasonably suspect unauthorised access or compromise of your credentials.
Accounts and Services may not be transferred, sold or shared with third parties without GenRDP’s prior written approval.
GenRDP may request corrections, supporting information or identity verification where reasonably necessary to prevent fraud, identity theft, payment abuse, unlawful use of proxy services or other material violations of these Terms.
4. Services and orders
The characteristics, price, billing period, country, connection type, selected mobile operator, plan and other applicable conditions are those displayed at checkout and recorded in the order.
You must comply with the traffic allowance, if any, duration, connection type, plan limits and other technical conditions shown for the purchased Service at checkout. Limited plans advertised as including 100 GB provide the stated allowance for the period or under the conditions shown at checkout.
Where use exceeds an applicable allowance, GenRDP may restrict, throttle, interrupt or suspend access, or may require the purchase of additional capacity, as reasonably necessary and as described at checkout or communicated to the Customer. Such measures may be applied manually by an authorised operator and must not be understood as a guaranteed automatic system function.
Submission of an order does not guarantee immediate availability. GenRDP may reject or delay an order where compatible capacity is unavailable, payment has not been confirmed, account information requires review, identity verification is reasonably required or fulfillment would expose GenRDP or a third party to legal, security or fraud risks.
Where immediate capacity is unavailable, the checkout or order status may indicate an estimated delivery period. Any stated period is an estimate unless expressly identified as a binding deadline.
5. Proxy characteristics
GenRDP assigns a compatible technical connection to the Customer’s Service. Within the GenRDP platform, an assigned connection is reserved for the corresponding Service while that assignment remains active.
Unless expressly guaranteed at checkout, the term “dedicated” does not mean that a physical device, SIM card, mobile-network infrastructure, public IP address or upstream network resource is owned by or physically reserved exclusively for the Customer.
Public IP addresses may change, including following an authorised IP-change request or changes made by a mobile operator or other infrastructure provider. Mobile connectivity may use carrier-grade network address translation or other shared network infrastructure.
The country, plan, selected operator and connection type recorded in the order are characteristics of the purchased Service. GenRDP will not treat them as freely interchangeable. If a material substitution becomes necessary, GenRDP may offer an equivalent alternative or another appropriate remedy, subject to feasibility, the circumstances and the Customer’s mandatory rights.
Hostname, port, route, latency, mobile signal, IP reputation, network performance and similar technical characteristics may vary unless expressly guaranteed in writing.
6. Third-party infrastructure
Delivery of the Services may depend on third-party infrastructure and providers, including technology providers, mobile-network operators, hosting providers and payment processors.
Third-party technology providers may process technical operations relating to network connections, proxy access, access expiry and IP-change functions. Mobile operators control their networks, coverage, signal, routing and certain public-IP characteristics.
GenRDP remains responsible to the Customer to the extent required by the contract and applicable law. The involvement of a third party does not by itself exclude GenRDP’s contractual responsibilities.
GenRDP does not guarantee uninterrupted availability where interruptions arise from maintenance, provider outages, mobile-network conditions, security incidents, force majeure or other circumstances outside GenRDP’s reasonable control. GenRDP will take reasonable measures appropriate to the circumstances.
7. Identity verification
GenRDP may request identity verification and may manually restrict specified account functions where reasonably necessary.
Verification may be requested where GenRDP reasonably suspects false identity data, finds a material inconsistency between account and verification information, receives a justified request from a payment or infrastructure provider or competent authority, identifies a payment method not reasonably attributable to the account holder, or detects circumstances indicating fraud, identity theft or unlawful use of the Service.
The current verification process may use Stripe Identity. Depending on the verification requested, Stripe may process an identity document and a real-time selfie. GenRDP does not ordinarily download or locally retain the document or selfie images, but may receive the verification result, status and identifiers necessary to manage the process. Stripe processes verification data under its applicable privacy and retention terms.
While verification is pending, incomplete or reasonably disputed, GenRDP may manually restrict purchases, provisioning, use of account credit or other specified account functions where proportionate and necessary. These restrictions are contractual rights reserved by GenRDP and are not representations that the current platform applies them automatically.
GenRDP will consider the circumstances of Services already paid for and any mandatory rights before applying or maintaining a restriction.
8. Acceptable use
You must not use the Services to:
- violate applicable law or the rights of another person;
- access accounts, systems, networks or data without authorisation;
- distribute malware or facilitate phishing, credential theft or fraud;
- send unsolicited bulk communications or engage in abusive automation;
- harass, threaten, exploit or unlawfully monitor another person;
- circumvent sanctions, court orders or lawful access restrictions;
- interfere with the security, integrity or availability of the Services;
- resell or transfer access without GenRDP’s written approval; or
- use the proxy infrastructure in a way likely to damage IP reputation, provider relationships or other customers.
GenRDP may investigate suspected abuse and may request information reasonably necessary for that investigation. GenRDP may restrict or suspend access, preserve relevant records, contact affected providers or competent authorities, or terminate a Service where reasonably necessary and legally permitted.
Such action may be taken manually. Nothing in these Terms represents that abuse detection, suspension or termination is guaranteed to occur automatically.
9. Prices, invoices and taxes
Prices and applicable taxes are shown at checkout or on the invoice. You are responsible for ensuring that billing and tax information is accurate.
A payment is considered completed only after it has been confirmed and credited through the applicable payment process. Pending, expired, reversed, underpaid or otherwise unconfirmed payment attempts do not require GenRDP to activate or renew a Service.
The payment methods offered may change. The methods available for a particular transaction are those actually displayed at checkout or on the invoice.
10. Cryptocurrency payments through CoinGate
Cryptocurrency payments are processed by CoinGate, a third-party provider of payment services involving crypto-assets.
Under the current merchant configuration, GenRDP requests settlement from CoinGate in EUR. GenRDP does not operate a cryptocurrency wallet for Customer payments and does not hold, transfer, safeguard or exchange Customer cryptocurrency or manage private keys as part of the Services.
CoinGate determines the exchange rate and payment window applicable to the transaction. The rate may change due to market volatility and is not determined or guaranteed by GenRDP.
Before sending a payment, you are responsible for checking the destination address, blockchain network, currency and amount displayed by CoinGate. Blockchain transactions may be irreversible. GenRDP cannot unilaterally recover funds sent using an incorrect address, network, currency or amount.
Problems concerning blockchain confirmation, an incorrect amount, expiry of the payment window or other technical aspects of the cryptocurrency transaction may require investigation or assistance from CoinGate under its terms.
Nothing in this section excludes GenRDP’s obligations concerning the underlying order or any mandatory rights available to the Customer.
11. Renewals
Services renew after the applicable renewal invoice has been paid and the renewal has been successfully processed.
Payment is manual unless the Customer has expressly authorised a supported recurring payment arrangement or saved payment method. Availability of recurring payment depends on the payment method displayed and supported for the account. Cryptocurrency payments through the current CoinGate integration do not constitute a saved recurring payment method.
GenRDP will not establish a new recurring-payment authority without the Customer’s authorisation. The Customer is responsible for reviewing invoices and ensuring timely payment.
Payment confirmation does not guarantee that every technical renewal operation will complete without delay. If a renewal cannot be confirmed, GenRDP may retry it or refer it for manual review.
12. Account credit and Add Funds
Customers may be able to add funds to their GenRDP account using payment methods available on the Add Funds page. Account credit is an internal billing balance and is not a bank account, electronic-money account or cryptocurrency wallet.
Unless mandatory law requires otherwise, purchased account credit:
- does not expire under the current commercial policy;
- is not transferable to another account;
- is usable only for eligible invoices and Services available through the account;
- is not normally redeemable or withdrawable in cash; and
- is normally non-refundable.
These rules do not affect any mandatory right of withdrawal or reimbursement available to a consumer. Where credit has already been applied to a Service whose performance began following a valid express request or consent, any withdrawal or reimbursement will be assessed under applicable law and according to the part of the Service already performed.
GenRDP may manually restrict the use of account credit while a reasonably required identity verification is pending or while fraud, payment reversal or account abuse is being investigated.
Promotional credit, goodwill credit and administrative adjustments may be subject to additional conditions communicated when granted.
Residual credit following account closure, termination, unresolved verification or discontinuation of the relevant Services will be handled according to the circumstances, the origin of the credit, these Terms and applicable mandatory law. No provision in these Terms authorises forfeiture where it would be unlawful.
13. Consumer right of withdrawal
If you are a consumer resident in the European Union or another jurisdiction granting a mandatory withdrawal right, you may have the right to withdraw from a distance contract within the period prescribed by applicable law, generally fourteen days from conclusion of the contract.
Where permitted by law, GenRDP may separately ask you to expressly request that performance begin before the withdrawal period expires and to acknowledge the legal consequences of that request. Acceptance of these Terms alone does not replace any separate express request or acknowledgement required by law.
If performance begins during the withdrawal period following a valid request, you may be required to pay an amount proportionate to the Service supplied before withdrawal, where permitted by law.
Any exclusion or loss of a withdrawal right applies only where all applicable legal requirements have been satisfied. Nothing in these Terms limits an inalienable consumer right.
To exercise a withdrawal right, contact assistenza@genrdp.com with sufficient information to identify the Customer and the relevant order.
14. Refunds and service remedies
Except where a refund is required by mandatory law, payments are not automatically refundable merely because the Customer no longer requires the Service, fails to use it, supplies incompatible information or violates these Terms.
Where appropriate, GenRDP may offer restoration of access, an extension, replacement, account credit, a partial refund or a full refund. The available remedy depends on the circumstances, technical feasibility, payment method and mandatory rights.
No particular remedy is guaranteed unless required by law or expressly agreed in writing. In particular, GenRDP does not guarantee that a refund can be made through CoinGate, in cryptocurrency, by bank transfer, through the original payment method or using any other specific channel.
Where a refund is due, GenRDP may select a reasonably available and lawful method after considering the payment method, transaction status, operational feasibility and Customer identification requirements.
15. Suspension, cancellation and termination
You may request cancellation using the functions available in the customer area or by contacting support. A cancellation request does not necessarily produce immediate technical deletion of remote access.
GenRDP may manually restrict, suspend or terminate an account or Service where reasonably necessary because of non-payment, fraud, material breach, unlawful use, security risk, provider requirement or failure to complete a reasonably required identity verification.
Where appropriate, GenRDP may provide notice and an opportunity to remedy the issue. Immediate action may be taken where delay would create a material legal, security, fraud or infrastructure risk.
Suspension or termination may require manual action by an operator. These Terms do not represent that the platform or any infrastructure provider automatically performs every lifecycle operation.
Following termination, GenRDP may revoke credentials, remove remote access and release an assigned technical connection. Timing may depend on operational verification and third-party systems.
16. Customer support and complaints
Support requests and complaints may be submitted to assistenza@genrdp.com. Please provide the relevant order or invoice reference and a clear description of the issue, but do not send passwords, private keys or unnecessary identity documents by ordinary email.
GenRDP may require reasonable verification before discussing an account, changing credentials, issuing a remedy or disclosing account information.
17. Liability
Nothing in these Terms excludes or limits liability that cannot legally be excluded, including liability for fraud, wilful misconduct, gross negligence where applicable, death or personal injury caused by negligence, or mandatory consumer protections.
Subject to the preceding paragraph, GenRDP is not liable for indirect or consequential losses, loss of opportunity, loss of profits, loss of reputation or loss resulting from unlawful or unauthorised use of the Services, to the extent such limitation is permitted by law.
Customers using the Services for business purposes are responsible for maintaining appropriate backups, security controls and alternative connectivity where continuity is commercially important.
Any limitation of liability must be interpreted in light of the nature of the Customer, the Service purchased, the amount paid, the circumstances of the loss and applicable mandatory law.
18. Indemnity for unlawful use
To the extent permitted by law, a business Customer will indemnify GenRDP against third-party claims, penalties and reasonable costs directly resulting from that Customer’s unlawful use of the Services or material breach of the acceptable-use provisions.
This section does not apply to consumers to the extent it would restrict mandatory consumer rights.
19. Personal data
GenRDP processes personal data as described in its Privacy Policy. Depending on the Services and payment method used, relevant recipients or service providers may include billing and customer-management technology providers, Stripe, Stripe Identity, PayPal, CoinGate, technical infrastructure providers, hosting providers, email providers, professional advisers and competent authorities.
For CoinGate payments, GenRDP ordinarily processes the payment result and billing information needed to reconcile the invoice, such as the EUR amount, payment status, transaction reference and invoice identifier. GenRDP does not require or store a Customer’s private wallet keys.
The Privacy Policy, rather than these Terms, provides the detailed information required by applicable data-protection law.
20. Changes to the Services and these Terms
GenRDP may update the Services or these Terms for legal, security, technical, provider or commercial reasons.
Material changes affecting an existing paid Service will be communicated within a reasonable period where required by law or contract. Changes will not retroactively remove rights already accrued or limit mandatory rights.
The version and effective date displayed on this page identify the applicable published version. Continued use after a validly notified change may constitute acceptance only where permitted by applicable law.
21. Assignment
You may not assign the contract or transfer an account without GenRDP’s prior written approval.
GenRDP may assign the contract as part of a lawful transfer of the business or relevant assets, provided that the Customer’s mandatory rights are not reduced.
22. Severability and waiver
If a provision is found invalid or unenforceable, the remaining provisions continue to apply to the extent permitted by law. Failure to enforce a provision on one occasion does not waive the right to enforce it later.
23. Governing law and jurisdiction
These Terms are governed by Italian law, without prejudice to mandatory protections that apply to consumers under the law of their country of residence.
For consumers resident in the European Union, jurisdiction lies with the courts determined by mandatory consumer law, including, where applicable, the courts of the consumer’s place of residence. No provision in these Terms imposes an exclusive business forum on a consumer where this would be unlawful.
24. Contact
For support, contractual communications, legal notices or privacy-related requests, contact assistenza@genrdp.com.
